Instant Rebate Terms and Conditions

In addition to Alteza’s standard terms and conditions, please carefully read the following brief terms and conditions for participation in the Instant Rebate Program.

The customer is required to pay applicable sales tax on the full sell price for the equipment shown on the invoice, not the amount due after the instant rebate has been applied.

The purpose of the Instant Rebate Program is to increase the energy efficiency of local food service establishments. Customers agree that any units receiving a rebate will be promptly installed at the documented location(s), and put into service. To confirm this, customers are responsible for documenting the completed installation by promptly sending photos and/or video of the installed units to Alteza. Further, to protect their significant investment in energy-efficiency upgrades, the utility provider has the option to perform an on-site installation inspection, which is limited to only the new equipment for which the customer received a rebate. If any units which received a rebate are found to not be installed on-site, the customer and/or business may be held liable for re-payment of the full amount of the instant rebates (hence the need for pictures to confirm installation).

Customer has the option to return any equipment in new or like-new condition, for a period of 90 days, for a refund of the amount actually paid by the customer, but NOT the amount of the instant rebate, which will be returned to the utility provider through Alteza and its business partners. Any products returned to Alteza that are used and/or missing the packaging will be subject to a 25% restocking fee on the sell price of the equipment. Customer has the option to return the units to Alteza’s warehouse or pay their own carrier to ship back. Other products and services, such as shipping, delivery, and installation, are non-refundable.

The Customer must inspect all shipments before signing the Bill of Lading, and Alteza is not responsible for claims related to freight after the Bill of Lading is signed.

This contract becomes legally binding upon payment of funds, and all terms and conditions outlined in this contract are acknowledged by all parties upon signing.

Product warranties are valid only if installation is done by a licensed professional.

Customer agrees to indemnify and hold harmless Alteza and Energy Solutions for any claims or damages arising from installation and use of products.

These terms and conditions are governed by the laws of the state in which the product was purchased and installed. Disputes must be resolved through arbitration in accordance with the rules of the American Arbitration Association.

Changes to these terms and conditions must be made in writing and signed by both parties.

The failure of either party to enforce any rights under these terms and conditions shall not be deemed a waiver of those rights. This agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, understandings, and agreements.
